Atkins Girl Denied Plea Of Jeopardy

LOS ANGELES, Apr. 30 – A Los Angeles Superior Court judge refused Wednesday to allow Susan Atkins to enter a plea of “once in jeopardy” to murder-conspiracy charges stemming from the death of musician Gary Hinman.

Judge George M. Dell postponed Miss Atkins’ case and that of her co-defendant, Hippie Chieftain Charles Manson, 35, until May 22 for motions to dismiss the county Grand Jury indictment against them.

Miss Atkins, 21, actually entered a plea of “once in jeopardy” but the judge struck it, ruling in this particular case, it had “no legal basis properly recognized by the courts of California.”

Neither Miss Atkins nor Manson has yet entered a plea of guilty or innocent pending the motions to dismiss.

The two defendants, along with Bruce M. Davis, 27, another member of Manson’s “family,” are charged with murder, and conspiracy to commit murder and robbery stemming from the July 27 death of Hinman, 34.

Davis is still being sought by authorities.

Miss Atkins’ attorney, Daye Shinn, told Judge Dell she was once in jeopardy because the district attorney has not yet dismissed a complaint charging her with Hinman’s death.

Normally, a grand jury indictment supersedes a complaint.

Dep. Dist. Atty. Burton Katz told Judge Dell the prosecution intended to dismiss the complaint “at the proper time.”

Proceedings on the complaint are pending in Santa Monica Superior Court because Hinman’s death occurred in Topanga Canyon — within that court’s jurisdiction.

Judge Dell said he did not believe Miss Atkins was placed in jeopardy because the complaint has not yet been dismissed.

Manson, Miss Atkins and another four family members also are charged with murder and conspiracy in connection with the August slayings of actress Sharon Tate and six others.

Trial in that case is scheduled to start June 15.
