THE COURT: Good afternoon, ladies and gentlemen of the Grand Jury.

Mrs. Bancroft, would you call the roll of the Grand Jury; please.

THE CLERK: Yes, your Honor.

(The clerk complies.)

THE CLERK: Twenty-one Jurors answer present, your Honor.

THE COURT: All right, I will have the record reflect that we have in the courtroom 21 members of the 1969 Grand Jury.

Mr. Bishop, do you have an indictment or indictments to present to the Court?

THE FOREMAN: Yes, I do, your Honor.

THE COURT: Would you please hand them to the Court through Mr. Wyatt, our bailiff.

Mr. Bishop, did fourteen or more Grand Jurors receive all of the evidence pertinent to the indictment that you have handed to the Court?

THE FOREMAN: Yes, they did, your Honor.

THE COURT: Did the same fourteen or more Grand Jurors participate in the discussions on this indictment?

THE FOREMAN: Yes, they did, your Honor.

THE COURT: Did the same fourteen or more Grand Jurors vote to return this indictment?

THE COURT: I will have the record reflect that the bailiff has handed to the Court Case No. A-253156, an indictment naming one, two, three, four, five, six named defendants.

The indictment is in eight counts.

The indictment contains the names of the witnesses on this case.

I will find that this indictment is a true bill.

I will order the Clerk of the Court to file the indictment.

Mr. Stovitz, all of the named defendants in this case are in custody in one place or another; is that correct?

MR. STOVITZ: Yes, they are, your Honor.

Two of them are in custody here in Los Angeles County.

THE COURT: All right, in this case, the indictment will not be a secret indictment.

We will have the record reflect the names of Charles Manson, Charles Watson, Patricia Krenwinkel, Susan Atkins, Linda Kasabian and Leslie Sankston.

The indictment is in eight counts, as I have stated, seven counts of murder and the eighth count being conspiracy to commit murder.

I will order that a bench warrant issue for the apprehension of each named defendant but there will be no bail on the bench warrant in each case.

MR. STOVITZ: I might say, your Honor, that Susan Atkins, Linda Kasabian and Leslie Sankston are presently in the Los Angeles County Jail at the Sybil Brand Institute.

If they may be set on the calendar the earliest possible date so that they may be arraigned that would help the administration of justice.

THE COURT: All right, in this case, I will order that the three named defendants currently in custody in Los Angeles County, Susan Atkins, Linda Kasabian and Leslie Sankston will be calendared in this court for arraignment -- any reason why we can't do that Wednesday of this week?

MR. STOVITZ: No reason at all, your Honor.

THE COURT: I will set the matter on our calendar. I will make it at 11:00 o'clock in the morning on December 10th.

INDICTMENT

The said CHARLES MANSON, CHARLES WATSON, PATRICIA KRENWINKEL, SUSAN ATKINS and LINDA KASABIAN are accused by the Grand Jury of the County of Los Angeles, State of California, by this indictment, of the crime of MURDER in Violation of Section 187, Penal Code of California, a felony, committed prior to the finding of this indictment, and as follows:

That on or about the 9th day of August, 1969, at and in the County of Los Angeles, State of California, the said defendants, CHARLES MANSON, CHARLES WATSON, PATRICIA KRENWINKEL, SUSAN ATKINS and LINDA KASABIAN did willfully, unlawfully and feloniously and with malice aforethought murder Abigail Anne Folger, a human being.

COUNT II

For a further and separate cause of action, being a different offense of the same class of crimes and offenses as the charge set forth in COUNT I hereof, the said CHARLES MANSON, CHARLES WATSON, PATRICIA KRENWINKEL, SUSAN ATKINS and LINDA KASABIAN is accused by the Grand Jury of the County of Los Angeles, State of California, by this indictment, of the crime of MURDER in Violation of Section 187, Penal Code of California, a felony, committed prior to the finding of this indictment, and as follows:

That on or about the 9th day of August, 1969, at and in the County of Los Angeles, State of California, the said defendants, CHARLES MANSON, CHARLES WATSON, PATRICIA KRENWINKEL, SUSAN ATKINS and LINDA KASABIAN did willfully, unlawfully and feloniously and with malice aforethought murder Wojiciech Frykowski, a human being.

COUNT III

For a further and separate cause of action, being a different offense of the same class of crimes and offenses as the charges set forth in all the preceding counts hereof, the said CHARLES MANSON, CHARLES WATSON, PATRICIA KRENWINKEL, SUSAN ATKINS and LINDA KASABIAN are accused by the Grand Jury of the County of Los Angeles, State of California, by this indictment, of the crime of MURDER in Violation of Section 187, Penal Code of California, a felony, committed prior to the finding of this indictment, and as follows:

That on or about the 9th day of August, 1969 at and in the County of Los Angeles, State of California, the said defendants, CHARLES MANSON, CHARLES WATSON, PATRICIA KRENWINKEL, SUSAN ATKINS and LINDA KASABIAN did willfully, unlawfully and feloniously and with malice aforethought murder Steven Earl Parent, a human being.

COUNT IV

For a further and separate cause of action, being a different offense of the same class of crimes and offenses as the charge s set forth in all the preceding counts hereof, the said CHARLES MANSON, CHARLES WATSON, PATRICIA KRENWINKEL, SUSAN ATKINS and LINDA KASABIAN is accused by the Grand Jury of the County of Los Angeles, State of California, by this indictment, of the crime of MURDER in Violation of Section 187 , Penal Code of California, a felony, committed prior to the finding of this indictment, and as follows:

That on or about the 9th day of August, 1969, at and in the County of Los Angeles, State of California, the said defendants, CHARLES MANSON, CHARLES WATSON, SUSAN ATKINS, PATRICIA KRENWINKEL and LINDA KASABIAN did willfully, unlawfully and feloniously and with malice aforethought murder Sharon Marie Polanski, a human being.

COUNT V

For a further and separate cause of action, being a different offense of the same class of crimes and offenses as the charges set forth in all the preceding counts hereof, the said CHARLES MANSON, CHARLES WATSON, PATRICIA KRENWINKEL, SUSAN ATKINS and LINDA KASABIAN is accused by the Grand Jury of the County of Los Angeles, State of California, by this indictment, of the crime of MURDER in Violation of Section 187, Penal Code of California, a felony, committed prior to the finding of this indictment, and as follows:

That on or about the 9th day of August, 1969 at and in the County of Los Angeles, State of California, the said defendants, CHARLES MANSON, CHARLES WATSON, PATRICIA KRENWINKEL, SUSAN ATKINS and LINDA KASABIAN did willfully, unlawfully and feloniously and with malice aforethought murder Thomas Sohn Sebring, a human being.

COUNT VI

For a further and separate cause of action, being a different offense of the same class of crimes and offenses as the charges set forth in all the preceding counts hereof, the said CHARLES MANSON, CHARLES WATSON, PATRICIA KRENWINKEL, LESLIE SANKSTON, LINDA KASABIAN and SUSAN ATKINS is accused by the Grand Jury of the County of Los Angeles, State of California, by this indictment, of the crime of MURDER in Violation of Section 187, Penal Code of California, a felony, committed prior to the finding of this indictment, and as follows:

That on or about the 10th day of August 1969, at and in the County of Los Angeles, State of California, the said defendants, CHARLES MANSON, CHARLES WATSON, PATRICIA KRENWINKEL, LESLIE SANKSTON, LINDA KASABIAN and SUSAN ATKINS did willfully, unlawfully and feloniously and with malice aforethought murder Leno A. La Bianca, a human being.

COUNT VII

For a further and separate cause of action, being a different offense of the same class of crimes and offenses as the charges set forth in all the preceding counts hereof, the said CHARLES MANSON, CHARLES WATSON, PATRICIA KRENWINKEL, LESLIE SANKS TON, LINDA KASABIAN and SUSAN ATKINS are accused by the Grand Jury of the County of Los Angeles, State of California, by this indictment, of the crime of MURDER in Violation of Section 187, Penal Code of California, a felony, committed prior to the finding of this indictment, and as follows:

That on or about the 10th day of August, 1969 at and in the County of Los Angeles, State of California, the said defendant,s, CHARLES MANSON, CHARLES WATSON, PATRICIA KRENWINKEL, LESLIE SANKSTON, LINDA KASABIAN and SUSAN ATKINS did willfully, unlawfully and feloniously and with malice aforethought murder Rosemary La Bianca, a human being.

COUNT VIII

For a further and separate cause of action, being a different offense but connected in its commission with the crimes and offenses as the charges set forth in Counts I through VII hereof, the said CHARLES MANSON, CHARLES WATSON, PATRICIA KRENWINKEL, SUSAN ATKINS, LINDA KASABIAN and LESLIE SANKSTON are accused by the Grand Jury of the County of Los Angeles, State of California, by this indictment, of the crime of CONSPIRACY TO COMMIT MURDER in Violation of Section 182.1 and 187, Penal Code of California, a felony, committed prior to the finding of this indictment, and as follows:

That on or about the 8th through the 10th day of August, 1969 at and in the County of Los Angeles, State of California, the said defendants, CHARLES MANSON, CHARLES WATSON, PATRICIA KRENWINKEL, SUSAN ATKINS, LINDA KASABIAN and LESLIE SANKSTON did willfully, unlawfully and feloniously and knowingly conspire, combine, confederate and agree together and with other persons whose true identity is unknown to commit the crime of MURDER, a Violation of Section 187, Penal Code of California, a felony. That pursuant to and for the purpose of carrying out the objects and purposes of the aforesaid combination, agreement and conspiracy, the defendants committed the following overt acts at and in the County of Los Angeles.

OVERT ACT NO. I

That on or about August 8, 1969, the said defendants, CHARLES WATSON, PATRICIA KRENWINKEL, SUSAN ATKINS and LINDA KASABIAN did travel to the vicinity of 10050 Cielo Drive in the City and County of Los Angeles.

OVERT ACT NO. II

That on or about August 8, 1969, the defendants, CHARLES WATSON, PATRICIA KRENWINKEL, and SUSAN ATKINS did enter the residence at 10050 Cielo Drive, City and County of Los Angeles.

OVERT ACT NO. III

That on or about August 10, 1969, the defendants, CHARLES MANSON, CHARLES WATSON, PATRICIA KRENWINKEL, SUSAN ATKINS, LINDA KASABIAN and LESLIE SANKSTON did travel to the vicinity of 3301 Waverly Drive, City and County of Los Angeles.

OVERT ACT NO. IV

That on or about August 10, 1969, the defendants, CHARLES MANSON, CHARLES WATSON, PATRICIA KRENWINKEL and LESLIE SANKSTON did enter the residence at 3301 Waverly Drive, City and County of Los Angeles.
